XII. Withdraw from the Agreement
Footer
Footer of FotoPressArt includes useful links and features which can make surfing easy and convenient.
The following links are available in the footer:
This link allows user to switch between Payment Method and also provides information about current method.
The Registration link opens User Registrations Page, while the Login link allows to login to FotoPressArt. This link also shows who is logged and allow to logout from the service.
If FotoPressArt provides you with photo services Private Gallery link is one you can use for login there. If you logged you can also use this link to logout.
Photographers can login to their account using this link. If you are not registered photographer and would like to work with FotoPressArt you can also use this link to register.
If you put any media in your shopping cart that will be indicated in Shopping cart link. Clicking on that link will direct you to your cart.
Live preview of media is a convenient feature, but if your network is slow or if browsing speed is an issue you can switch it off using this link. You can also use it to switch the preview on.
FotoPressArt serves customers in two main languages English and Polish. You can choose your language by clicking on the flag icon.
Additional links in the footer will help you to open information pages about FotoPressArt, Contact form, Terms and conditions of use FotoPressArt and License agreement. If you wish to subscribe to FotoPressArt Newsletter then typing your email address in the subscription window and pressing Sing up button will add your address to subscribers list.
I. Gallery
FotoPressArt’s photos are stored in Gallery which contains three main categories: Photo, Press and Art.
Photo is a category where you can find photography for all types of use including advertising, business, publishing or personal use.
Press is a category of photography for editorial use only. The editorial photos must be used in an "editorial" manner, which means use relating to events that are newsworthy or of public interest. The editorial photos must be used with description of the event including at least name of the event, time and place. Use of Media from Press category in non-editorial way may require a special agreement and additional license.
Art includes photography which is related to different kind of art activities like theater, ballet, dancing, painting, sculpture, music, photography, performance, graphic, etc. Art inspires and makes us innovative that is why we keep this photography in a separate category, however it sometimes overlaps with Press and Photo category.
FotoPressArt provides photo services e.g. fashion photo sessions, business assignments, reportage or weddings. If you are customer for such services your pictures from the assignment will be available in Private Gallery. The access to Private Gallery is from User menu and requires login credential available from FotoPressArt.
To use the photo in your web or print publication you need to purchase a License.
To purchase a photo print you need to select a type of paper and print format. The Photo prints are prepared using high quality Epson K3 UltraChrome Technology ensuring long life of the prints up to 108 years for color and 200 years for black and white under rigorous industry accepted display conditions. We offer two type of prints Premium and Baryta. The Premium print is on high class photo paper. The Baryta print is on the top class Baryta paper.
The digital photos, videos, text, graphics and photo prints we name Media .
II. Searching
The easiest way to find a media is searching for it in the Gallery. You can start searching in two different ways shown on the screenshot nr 1.
Selecting “Search” from menu and go directly to Advanced Search page or click on a magnifying icon on the right and type keywords describing the object you are looking for in Search FPA box on the menu bar.
Media have embedded keywords to allow more selective searches. The scope of your search results will be determined by your selection of keywords.

1) Quick Search
Typing a keyword in the Search FPA box on the menu bar and pressing enter return a number of media which includes at least one word you typed. This is the default Quick Search setup ("Match at least one keyword"). If you input two words e.g. “beautiful dancer” then the search function will return results for any media that contain either "beautiful" OR "dancer" in its properties.
- The system supports the "AND" and "NOT" operands in the quick search function by the use of the plus sign (+) and minus sign (-) respectively in front of the keywords.
- If you input "beautiful +dancer" into the search field, the system will only return results for any media that contain both keywords "beautiful" AND "dancer" in its properties.
- If you input "beautiful -dancer" , the system will return results for any media that contain the keyword "beautiful", but this media can't contain the keyword "dancer" in its properties.
You can limit the number of Quick Search options by clicking on grey arrow top right correnr of the menu.
Note: There must not be any spaces between the second keyword and the input operands (+), (-) keywords.
2) Advanced Search
The Advanced Search function uses different algorithms than Quick Search. It offers options allowing you to choose which operand you want to use for your searches. There are three options available.
- Match at least one keyword
The system will return results for any media that contains either one of the input keywords in its properties.
- Match all keywords
The system will only return results for any media that contain all input keywords in its properties.
- Match exact phrase
The system will only return results for any media that contains the exact input keyword phrase in its properties.
The search feature offers many additional option to improve accuracy and speed of searching. You can narrow search to media types, license type, colors on pictures and their combinations. Try it, test it and choose your favorite.
Additional help in searching are keywords listed in Search suggestion and Keyword cloud area. Clicking on such a keyword will provide you with search results relevant for that keyword.
III. Registering and Account
The customer Account is required to use some features of the service e.g. multiple Lightboxs, tracking status of orders and payments, uploading purchased madia from the service directly to your remote ftp server, using subscription payment methods. To create an account you must register and provide registration details like your name, email and phone number. We use those data for responding to your orders and queries. You can register by clicking the registration link on the left in footer or on Customer Login page. If you lost your password you can Recover it on the Login page. All your registeration details are subject to FotoPressArt Privacy Policy defined in Terms and Condition of FotoPressArt.
Optional way to login is to do it with your Facebook account. It is quickest and easiest way. You may need to update your billing and shipping information during checkout if the required info is not provided by Facebook.
If you are using the service on behalf of a company please provide the company name and tax number too.

IV. My Account
You can login to your account on Customer Login page or through popup window if login is required for using the feature e.g. changing of payment mode. To go to the login page you can click on the Login link on the left in the footer area or User menu.
On your Account page you can do the following:
Review your order history
Change the payment method
Edit Your FTP server details
Edit Your Profile
Logout
Editing your FTP settings may need configuration details of your FTP server. If you don't know them please ask your admin.
In Order History you can review each order by clicking the order number link. Depending on the type of the order e.g. for subscription or for product different preview and printing options are available. The following order actions are possible to use:
Download purchased photos available for downloading.
Upload purchased photos available for downloading to your FTP server.
Check the status of the shipping of prints or products.
Print the invoice.
Checkout orders with Not paid status.
Review orders for media paid through subscription or package orders.

V. Lightbox
The Lightbox is your collection of photos you like or consider for future purchases or sharing. You may add up to 30 images to your Lightbox. If you wish to purchase a License or Photo print from your Lightbox you can click on the thumbnail and go to the detailed Media page and then select a required one.
The main Lightbox features allows:
Removing all photos from the Lightbox.
Refreshing the Lightbox after changes.
Sending the Lightbox by email.
Request a quotation for photos in the Lightbox.
Create a PDF from the Lightbox.
Manage your Lightboxs.
You can use multiple Lighboxes and switch between them using a dropdown menu with Lightbox name or from the Lightbox manager page. The photos in current Lightbox are availabe on the bottom Lightbox bar too.
The following Lightbox features apply directly on Media:
Removing Media from the Lightbox.
Generating link to the Media.
Share Media with others using social services, email or other.
Adding a comment to the photo for future consideration.

VI. Media Detail
You can view the image in higher resolution and its details on Media Detail page. You can open the page by clicking on the media thumbnail.
The following user functions are available on the page:
View the geo location of the object on the photo.
Send by Email.
Request a quotation for license other than default one.
Add to Lightbox.
Generate links.
Share or bookmark the picture.
Add comment to the picture and post it on Facebook
You can buy licenses and other product on that page. The first step is to select the type of license or product.
Some media are offered with Royalty Free and some with Rights Managed license. To get the price for Rights Managed License you need to select all required parameters of use in the Rights Managed Calculator.
FotoPressArt may also offer products e.g. frames. Prices for such products are available under Royalty Free tab.
If you want to buy a photo print of the image you can order it using Photo Prints tab. To place such order you are requested to select format, type of paper and other option to calculate the price.
Once you select the License, product or photo print please click on the "Add to cart" button and then it will be added to your shopping cart.

VII. Shopping Cart
The shopping cart displays your shopping details, if you wish to delete an item from your order before proceeding to check out, simply hit the remove icon 
in the Action column.
For tangible products you can change the quantity before proceeding to checkout. Please press Update button after you changed the quantity to make the cart value corrected. Please note that you can't order more items than available in our stock.
Before going to checkout you need to read and accept the license terms and condition defined in the End User License Agreement (ELUA). This important document defines your rights to use medias and products. Once you accept the ELUA you can press Check out button.
If you purchased package or subscription you will have an option to choose between different payment methods in your cart. Please see the Screenshot 6 in the Payment section.
VIII. Checking Out
There are two options available for checkout. You can checkout as a guest or as a registered user. We recommend registering because this will allow you trucking your orders, payments and using other features of FotoPressArt. Checking as a registered user is also more convenient as you will not have to retype the billing and shipping information for future orders.
Once the Billing and Shipping information is completed you can proceed to the payment by pressing Check out button. After that you will be transferred to Order Confirmation page.
If you have a Promotion Code you can type it in the field available under Grand Total line of the order. To apply the code press Apply button.
If you share FotoPressArt site in social media then a site sharing discount may apply to on your purchase too.
The payment for the order can be done via PayPal service or as Offline Payment. You need to click on the button relevant for your payment choice and then login to your PayPal account or pay using traditional bank wire transfer or cash. For cash payment please contact us using the following form FPA as details need to be agreed before. The offline payment may delay execution of your order till the moment the payment is booked on FotoPressArt account.
Orders paid by PayPal are executed immediately once the transaction is registered in PayPal and FotoPressArt.
IX. Payment Method
By default payment method for media, subscriptions or packages is Pay per Purchase. Using the method you will be requested to pay during the checkout.
The other payment methods are based on subscriptions or packages. The subscription/package payment is available for user only after completion of orders for subscription or package. The subscriptions are available on the subscription page available from User menu. Payment for subscription and packages can be only done using Pay per Purchase method.
If payment Subscription or Package are available you can switch between them and Pay per Purchase using Payemnt Method icon on Your Account page or clicking in Payment method link on the left of the page footer. The current payment method is indicated in the footer bar.
Subscriptions
FotoPressArt offers 3 types of subscriptions.
1) Duration Subscription
Subscribing to this subscription type will allow you to purchase any media that are available for this subscription prior to its expiration date. The expiration date is calculated based on the date of payment for the subscription.
2) Credit Subscription
Subscribing to this subscription type will allow you to purchase any media that are available for this subscription if its credit cost is less or equal to your remaining credits. The subscription credits are deducted from your account each time you use it for your purchase.
3) Package Subscription
Subscribing to this subscription type will allow you to purchase any media that are available for this subscription. You can only use this subscription for a one time purchase. We only allow you to checkout your order when the subscribed package contents and your current shopping cart contents are an exact match.
Select the subscription type as desired and click on Check out button to complete the purchase. Once the order is completed the subscription will display in the Payment Method section.

X. Licenses
We offer media with two types of licenses:
Royalty Free License
Rights Managed License
1) Royalty Free license allows you to use the media in the following way:
a) Web Usage
You can use the media on one web domain only. It can be used on as many web pages within that same domain as you desire.
The media can be altered if necessary, but they cannot be included in any composite that is resold.
b) Print Usage
You can use the files in printed publications, product packing, software, applications (including mobile “apps”), magazines, books, e-books, newspapers, advertising collateral, business cards, letterheads, product labels, discs covers, marketing materials provided that no media cannot be readily unincorporated from such digital media or software.
c) Display
You can use the media in print or digital material intended for public display including point of sales materials and trade show boots. You can also use the media for decoration, provided it is your personal, non-commercial use, not for resale, download or distribution or any other commercial use.
2) Rights Managed license defines in details the usage of the media.
There are five main areas of media use:
- Advertising
- Editorial
- Marketing and Promotion
- Internal Company Use
- Retail
- Personal Use
It is also possible to buy an exclusive license to use the media on all above fields.
Each media use has several options relevant for area of use which precisely define the way the media can be used. The Rights Managed license price is calculated based on your parameters. The Rights Managed calculator is presented on screenshot 7.

You may request a dedicated quotation for a License, especially if you would like to use the media on different fields or if there is any other reason justifying such dedicated quotation.
You cannot use the file in the different way than the one defined in the purchased license.
Detailed terms and conditions are available under End User License Agreement (EULA). In case of any doubts the End User Agreement prevails.
3) Picture size
The images for download are offered as JPEG in the following size:
JPEG Small - longest edge 1000px
JPEG Big - longest edge 2000px
JPEG Oryginal - longest edge more than 2000px
The Rights Managed pictures are offered only in one size i.e. original file minimum 4 megapixels.The picture below shows the ratio between different image sizes. The longest dimension of this sample picture is 500 pixels.
XI. Photo prints
1. The photo prints are prepared based on your customized order. You need to select the print size, paper type and quantity of prints before placing the order.
2. FotoPressArt will complete the order as soon as possible but not later than 5 working days from the date of payment. In case of delay FPA will contact you to inform about such fact and arrange for alternative delivery date or to withdraw from the order.
3. FotoPressArt will send the order by Polish Post. Should you wish the printout to be sent by other parcel service please contact us before placing the order. The default shipment prices apply only for shipment in Poland. For international shipments please contact FotoPressArt before placing an order.
4. In the event of order cancellation FotoPressArt will refund the amount paid within maximum of 5 days from the date of order cancellation or receipt of the payment whichever occurs later. The refund will be made on the user account.
5. The User should inspect and unpack the package in the presence of the deliverer and if mechanical damage caused during transportation to prepare the protocol of damage signed by the bearer of the damage and the User. This protocol is a prerequisite for the recognition of a claim for damage during transportation by FotoPressArt. Otherwise, the User can claim any compensation directly from the shipping company, and the FotoPressArt will not be a part of this dispute.
6. FPA will inform you about shipment of ordered products via e-mail. Any claims arising from delay in delivery or loss of the consignment shall be considered based on rules of the carrier. In case of loss or destruction during transportation and positive acceptance of the claim by the parcel service, FotoPressArt will refund you the full amount paid on your bank account.
XII. Withdraw from the Agreement
1. FotoPressArt informs that in accordance to Polish Consumer Law dated 30 May 2014 (Dz. U. 24/6/2014 Poz. 827) chapter 38 the consumer right to withdraw from the agreement without giving a reason doesn't apply on agreements related to digital content, which are not recorded on tangible product providing the Agreement is executed before the date of withdraw and is accepted by Licensee. The right to withdraw from the agreement without giving a reason doesn't apply on products and services if they are prepared based on consumer specification or are used to fulfill his specific needs.
2. In case of products and Media other than described in chapter 1 consumer has a right to withdraw from the Agreement without giving a reason within 14 days from the day of receipt. In the event of withdrawal, the Agreement is considered null and void, and the User is exempt from any obligations. The return of the Media in this mode will be accepted providing the Media is returned in the same state, unless a change was necessary in the ordinary course of business. The Media must be returned in original packing, secured and with the written notification about withdrawal from the Agreement. If the User wish to take the advantage of this right of return, the User agrees to send a written notice about such intention to FotoPressArt in advance, by sending an email to sales@fotopressart.com. The e-mail must include the User name, order number, name of the Media, the User's account number for refund. The return transportation cost will be paid by the User. FotoPressArt agrees to reimburse the amount of money paid for return Media on the User account within 14 working days from delivery date of the product to FotoPressArt's premises.
3. The User should send the form of withdraw from the Agreement only if he would like to withdraw from the agreement. Here is the example of withdrawal form.
